Dear lawyer, I heard that someone get 2 years conditional green card through L1 category, as far as I know only EB-5 and green

card through marriage are of this 2 years conditional residency. Is it true that an L1 visa holder can also get a two-year conditional green card?

Is investing in a RC a shoot and forget stuff!?

Imagine a case where I-526 is approved, and investment is already done in a chosen EB-5, and the 2 year timer starts to tick. Considering no involvement by the investor in the RC, shall he just wait till last today to see if the investment worked out the way it should, i.e. created 10 jobs, etc., or can there be any monitoring measures in place to see how it is going?

If the wife immigrates to the U.S. through eb-5, and her husband stays in China doing his business,

does her husband also subject to the U.S. tax report obligation? If they file tax return seperately one in the U.S., one in China?

Note, in this case her husband does not apply for an immigration visa.

New policy change on July 21, 2010? Does the new "Dodd-Frank Act" have any affect on current eb-5 program?

Or say does an investor need to prove that he/she has at least $1 ml asset to qualify for an “accredited investor,” before he can file I-526.

As far as I know, there is no asset requirement for eb-5 investors yet. Does this change because of the dodd-frank act?

Dear eb-5attorney, can employee of an existing and operating business be counted into jobs created by this RC?

This is about a hotel eb-5 program currently promoted in China.

The concern is that even before the RC is set up, the project, the hotel was up and running. It is now an eb-5 project. The principal claims that the current employees can be considered as temp workers. With the eb-5 money coming in, they then become full time jobs and can be used for I-829 purpose.

There is not a mechanism to restrict the eb-5 principal to operate eb-5 projects on behalf of their investors who only passively involve in management. Is this fair? Actually it is always a confliction between the best interest of an eb-5 project principal who wants to make more money and 10-job-creation requirement that is needed to remove condition in the I-829 phase.

Marriage

I have received my conditional green card through a regional centre.
If I get married before application to remove conditions can my wife be included? What would her status be? She is currently in the US on a student visa.

Potential EB5 Investor denied B visa

Hi: I had a client who was interested in traveling to the US to look at our Regional Center. He is a Macau resident (So he applies in the Hong Kong Consulate). He is a high net worth person. He showed he owns millions of USD in property in Macau, had about 1 million USD in a Macau bank account, substantial business, children in best schools, etc.
