It would be more helpful if the article had provided some examples of how USCIS is violating law by issuing the EB-5 guidance memo. We are not sure providing AILA's position will really change things, although it's a start. As far as we can tell, the Dec. 11, 2009 guidance memo from Neufeld creates more issues than it addresses them and ultimately is an unworkable scheme. We believe experienced EB-5 practitioners and regional center principals realize this. We hope we can see AILA's position as soon as possible.
