ifI am currently not in the US on a non -immigrant visa, do i need to meet the requirement of "Accredited Investor" under US SEC rules to qualify in the EB-5 program? Will my i-526 e rejected if my networt is 700 K?
Basically, the USCIS does not review whether an investor applicant is an accredited investor, whether you are one or not will not affect your immigration case. Having said this, this requirement arises from the United States SEC law (in which I am not an expert) which applies only to those investors who are a "resident" of the United States. Although the definition and concept of "resident" is a flexible one, if you are not physically in the United states on a NIV, then you definitely are not subject to this requirement, so you have nothing to worry about. That's what we think.

No, we don't think so. The "accredited investor" applies at the time of the investor choosing to participate in the EB-5 project. But your question was a good one from a logical perspective.
