See the Yates' Memo dated June 10, 2003 that explains amendments affecting eb-5 adjudication due to the previous amendments by statutes. Specifically, the EB-5 amendments included the doing away with the establishment requirement of a new commercial enterprise; no longer requiring the job-creation be related to export activities within the region; revising definition of "full-time" position; and confirming that a limited partnership can be a new commercial enterprise.
